Busted For Pot? Have Your Record Wiped Clean Under New Bill

If you were convicted of a marijuana related crime that is no longer legal thanks to recreational use, you could get your record wiped clean the Nevada Assembly announced with new legislation Tuesday.

Nevadans convicted of possessing and using one ounce or less of marijuana flower or one-eighth of an ounce of marijuana concentrates, like shatter or wax for recreational use is no longer a crime in Nevada.

“This is to help low-level drug offenders have this removed or vacated,” said freshman Assemblyman William McCurdy, (D-Las Vegas), to the Assembly Committee on Corrections, Parole and Probation.

Assembly Bill 259 would relieve the charges from those who were previously convicted of using or possessing the now-legal amount that went into effect Jan. 1, 2017.

Residents charged for possessing or using more than the legal limit, be eligible to have their convictions removed.

The bill stops short of pardoning those convicted of selling or transporting marijuana over state lines as this is still illegal in Nevada.

McCurdy’s bill would also remove mandatory minimum sentencing for drug offenders in Nevada in favor of substance abuse treatment.

If passed into law, the bill would most benefit those who were convicted “decades ago” under the now controversial war on drugs.
